Working with Gil

Gil is very selective on the products he works with and only takes on products he feels have a good chance at market success, and, as importantly, has a good chance at getting a licensing deal. If Gil chooses to work with you, here is what you should expect:

Gil will provide you with his Representative Agreement. Gil doesn’t waste time or want to tie up your product. Most Representatives will ask you for a six month contract. Gil’s contracts are for 90 days. He usually needs only 60 days to get you a deal.

The first step in obtaining a licensing deal is making sure your product opportunity is “deal-ready”. Gil has a lot of experience in developing raw ideas into market opportunities through his own products and he knows exactly what the marketers are looking for. This may include filing for a patent and/or trademark, developing prototypes and preparing a demonstration video. Gil provides an assessment of what is needed and will help you get there. He may make a financial investment if warranted. Others charge thousands of dollars for these services of which Gil provides at no charge.

Since Gil considers a network of more than 50 marketers when shopping your product, you should have the best chance at getting a licensing deal when working with Gil. Oftentimes, inventors will shop their product to 3-4 marketers, get rejected and then give up. Gil does not give up until he has completely shopped the market and determines that your product is not licensable.

Because Gil has personal one-on-one relationships with the top decision makers at these companies, he will get your product in front of the right people in the quickest time. By shopping your product on your own, you may not be able to get it in front of the right people in a timely manner. This increases your odds at getting a licensing deal quickly. Gil promises “interest” in 30 days and a deal in 60 days and sometimes, it may be shorter. An inventor could spend years trying to market their product on their own.

Because Gil has such as large network, you will also be ensured that you get the best deal with the best marketer. Gil is very skilled in negotiation, particularly when it comes to licensing DRTV products.

Because Gil has relationships with top people at these companies and brings them a lot of products, you should receive more favorable treatment then you would on your own with just your one product.

Gil will help you complete the licensing contract. Gil is very experienced in licensing contracts and oftentimes, the inventor elects not to use an attorney because Gil’s work is sufficient to complete the contract. Please note that Gil is not an attorney and advises all his clients to seek legal counsel as part of completing the contract. However, Gil has saved thousands of dollars in legal costs for his clients.

Gil is a licensed CPA and can help you evaluate the financial aspects of the deal. He can also help in making sure the royalties are being calculated and paid correctly.
Gil is your Representative and Advisor. He gets offers from marketers and advises you which one to take. The decision is still yours to make as this is your product.

Gil does all of this on speculation and invests all his time and relationships for a percentage of what you get. He doesn’t make money unless you make money.

WHY LICENSING VS. DIY

Venturing into the DRTV business, or any business, is quite risky.

The proposition is simple:

Produce a product

Produce a commercial

Perform a media test of the commercial and see if you have a “winner”

The problem is that it could cost you hundreds of thousands of dollars and there is a 95% chance that it will fail if you DIY. That’s right; statistics show that only 1 in 20 TV commercials succeed past the initial media test.

As mentioned, Gil found this out the hard way by trying to DIY for 10 years.

By licensing your product to a direct marketer, you do three things:

Increase your chance at success.

These are the experts with deep pockets and long track records of success. They have all the money and human resources to make it a success. A primary reason for failure is a lack of adequate financial capital. Their success rates range from 10%-50% depending on who the marketer is. Far better than the 5% chance you have if you DIY.

Limit your investment and risk.

Once you turn it over to the marketer, you don’t have to do anything else besides go to the mailbox once a quarter and collect a check.

Make sure you get “paid first”.

If you license your product, you get paid “first” and on sales not profits; so, the project doesn't have to be real profitable for you to make money. If you DIY, you are the “last” one to get paid, after all your vendors and investors.
